Red Oak City Council Advances Alcohol Social Districts Ordinance on First Reading

 

 

Red Oak took the first formal step toward creating alcohol social districts Monday night when the City Council unanimously approved the first reading of Ordinance 2026-05.

 

The ordinance, enabled by recent state legislation that took effect July 1, 2026, allows the city to designate specific geographic areas where customers of licensed establishments may legally carry open containers of alcohol outdoors during council-approved events. Burlington initiated the state law; only a handful of Iowa cities have begun adopting local ordinances.

 

City Administrator Lisa Kotter explained that current law ties a liquor license tightly to a premises. Patrons cannot walk from a bar on the square to a concert or car show without violating the law. Social districts create a mapped “bubble” that participating licensees can activate for a defined event by resolution.

Key requirements include:

• Alcohol must be served only in clear, logo-marked plastic cups (no glass or original cans/bottles).

• Each participating business must use its own identified cups so enforcement officers can see the source.

• The district is activated only by a separate council resolution that lists the event, dates, hours, and participating licensees.

• The city retains authority to suspend operation for safety reasons.

Public commenter Larry Brandstetter asked the council to expand the proposed maps. He suggested adding the city-owned white storage building near the YMCA parking lot and the Legion Park shelter
